Jefferson County sewer debt talks grace period crucial to solution al.com (blog)
BIRMINGHAM, Alabama -- Jefferson County residents may be weary of the county's sewer debt crisis, but a decision Friday to extend settlement talks with creditors by another month is a wise move, say several bankruptcy experts and lawyers.
"We're all tired of this, but if the parties can get to a negotiated settlement then that's probably better," said Michael Floyd, professor of law at Samford University, on Saturday. "Almost always a negotiated settlement is better than bankruptcy because it reflects the parties working together to craft their own deal on what's best for them, whereas a bankruptcy court may have the ability to force some options on the parties."
The county has struggled unsuccessfully since 2008 to reach a settlement with creditors including JPMorgan Chase & Co., the Wall Street investment bank, on its $3.14 billion sewer debt. An agreement would avert the largest government bankruptcy in U.S. history.
Negotiations between the two sides intensified 10 weeks ago after the county lost its occupational tax in a court decision and the Alabama Legislature declined to provide a means of replacing that revenue, about $66 million a year.
