The seven years that you guys are talking about is the time allowed to keep a dept showing on your credit report, the statue of limitations is different in each state in PA its four years,BUT if the collection agency calls after the four years and you admit to owing the dept then the statue starts all over again. As far as Australia goes I have no idea you would have to do a search on the net for laws governing your area.
Where do I find debt help in Australia?
I've made some very bad choices. I have debts all over the place amounting to at least $8000. Some of the debt collectors are charging interest at a rate I cannot keep up with.
I want a chance to fix it, but I have ruined my credit rating and I have no assets. I don’t think a credit provider will lend me the money to consolidate it all. Should I just file for bankruptcy?
try doing a google search on debt help.
You will need to consolidate these all into 1 loan type with a low interest rate and try and pay the loan off over time.
Bankruptcy is really not an option unless you never want to own a house or car and never wish to borrow money ever again.
Talk to these debt collectors about your options, if they are not interested (and they wont be) look on google for debt help assistance.
im getting letters from debt collectors?
im a new zealander and have lived in australia for 17years and still reside here.
A few years ago now i was overpaid by new zealand work and income(which is same as centerlink).I was told that i owed $600 so i paid $200 and then i didnt know what i was really paying for i was just told to pay from nz.I stopped paying and had threats from debt collectors in nz saying they will take money from my pension here in australia or my bank account.I changed my bank a/c and asked the debt collectors forvalidation of debt as didnt really know what i was paying as their was n o invoice...well they left me alone for awhile..now they are threatning me again saying they will take money from my bank.Can they do that as i have changed banks,but im not sure if they can get infomation from centrelink.As far as centrelink goes in Australia i dont owe anything,but nz debt collectors want stop sending me letters saying they will take my money.Im a disability pensioner and im really struggling.
I did start to pay but i didnt know exactly wot it was for.

Yes they can get information from Centrelink such as bank account details. They will be able to garnish your bank account or your pension but as you're on welfare payments they will only be able to garnish a small amount each fortnight. Best to contact work and income before things get messy.

I have just recieved a letter from the debt collectors for Orange for an outstanding amount of around £600. I reported a robbery from my room in Australia around 5 years ago whilst travelling. I had a police report. I also informed the insurance company but stupidly forgot to inform the phone company until 10 days after (It was 4am at the time). I called them and they said that the phone had not been used and I cancelled it. I was out of the country for a further 6 months so recieved no further correspondance from them regarding the matter. I no longer have the police report. What should I do next? Me and my wife are having a baby soon and dont have the money to pay.
they probably just blocked the IMEI and sim card not cancelled the contract, unless you were outside your 12/18 month commitment, without having upgraded or anything then they should have cancilled the contract aswell.

I don't know for certain. I'd seek immediate advice from the Citizen's Advice Bureau. This is the sort of thing they give advice about really well. I'd try to go on Monday, even if this means taking a day off work. Your employer should allow this because it's an urgent matter that must be resolved. Don't phone or write to the debt collection company until you've seen the CAB.
You can telephone National Debtline on 0808 808 4000 for advice. You might want advice on how to deal with debt collectors (who often talk nonsense about what they do and don't have the power to do) and how to negotiate if you do have to pay. In the longer term, you might need CAB's help for consumer rights advice, but you may not be able to get seen very quickly.
Responsible lending or borrower's fault?
I moved to Sydney from Birmingham(U.K) last October and have been working fulltime since. When I left the UK I owed some money on my laptop that I gave to my exGF and she promised to take care of the money I owed on it (about £387) but she didn't, so the bank (HFC bank a part of HSBC group) have been sendin me claim letters for the past 6 months because I have an active current account with HSBC, UK and they have my address in Australia. However the letters arrived too late for me to take any serious notice about paying the debt off. (like 10 days past the 'pay by/contact us' date)
Recently they sent me a letter saying my account has been transferred to a firm of debt collectors in Australia. Would this affect my credit rating in Australia?

I have a personal loan in Australia that is about 25,000. I have been trying to make payments, but have not been able to make the same amount. The account is no longer visible on my internet banking, which I guess means it's gone to debt collector - It's my own fault, and I should have tried to rectify the situation sooner but I was just too embarrassed. Is he scared of doing his tax? Its funny some people think something like this will go away, but it wont. He might even get a return back. If the tax office owes money they'll pay it out. BUT if he does owe something the fines for delaying lodging and the interest they back charge could be a killer.
You say their family is growing I assume that means new baby, it could just take your friend to update her family assistance details with Centrelink for the ATO to catch up with him.
But hey I'm sounding too scary now. The ATO are pretty good, if people actually spend the time to talk to them and explain things. They'd generally give him a chance to pay it all off even in small amounts, like any other debt. I doubt the ATO has powers to cease assets just like that.

My father has an outstanding credit card bill to which the collector has contacted me and requested that either myself or another member of the family settle the bill (my father is unwell and not earning an income). He had told me over the phone that unless the bill is paid that our family home (which is in my father name) would be sold or a caveat placed on it. I requested he send me a copy of the court order to proove the debt exists before i entered into any repayment arrangments. The copy of the court order was received yesteryday, and it is dated July 2000. It is nearly 8 years since this judgement was granted and my question now is can the debt collection agency still enforce this today ? I am in Melbourne Australia. Thank you.

I don't know about Australia, but here in the US a credit card bill is usually about 6 years. However, if it has gone to Court, than it becomes a matter of public record and the time they can collect is much longer. It may be like 15 years or an indefinite amount of time.
