Because of the United States debt crisis, many folks in debt have succumbed to debt collection terrorism. Which is a better job....and looks better on a resume. Debt Recovery Agent (Collections) or a Bank Teller??
I worked in a bank for nine long years. Neither a bank teller nor a debt recovery agent is a position I would dream on. Both of them are stressful.
If you had to choose between one of them, I would choose to be a bank teller. You don't get yell as often as a debt recovery agent might get. Calling to remind people what they owe to the bank is a sad thing. I hate being called!
Tellers don't have a glamorous job, but at least they learn all the financial terms, and have two-way communication with customers

my girlfriend is paying a mortgage for her house and owes a credit card company £1000.00 She has received a letter from the land registry agency saying a debt recovery agency has bought her land can this be right ? She lives in the uk
The creditor cannot have "bought" her house or to have had it transferred simply because of the credit card debt. Presumably the debt is unsecured i.e a simple credit card not a second mortgage or similar.Therefore the company can only pursue the debt by a County Court action and will need a judgment before they can enforce it.You would have received County Court papers before now if they had gone that far.If they had a judgment one of the ways they can secure it (but not get their hands on the house ) is via Charging Order.They would simply get paid when the house is sold after the mortgage is redeemed. It is possible that the letter refers to another type of Land Registry entry called a "caution" but that would still not mean the creditor has bought the house.
I suggest a telephone call to the Land Registry who will be able to clarify the contents of the letter although will probably not want to comment on how to deal with the debt.Otherwise a visit to the CAB to run through the letter and advise.
I take it her property is freehold, anyway if it were lease hold under the law she has to be offered first refusal, contact a solicitor, get in touch with the Land Registry and get more details.
Contact your mortgage provider and ask what they know it, it is possible the debt collectors said they represented you.
Your girlfriend has an interest in the land. This will be either a freehold or leasehold interest. The interest which she herself has CANNOT be bought without her consent and signature.
Other things can happen, however.
If she owes £1000, this may have been secured as a loan against the property. If so, it operates in much the same way as a mortgage. Your girlfriend would have had to sign the paperwork to permit this to happen. Hopefully, she would have kept the papers. These should be read through in detail.
Alternatively, the debt has just arisen in the normal course of credit card business. If that has happened, the company (or agency to which the debt may have been sold) has the right to sue in the County Court to obtain a judgement against her. If that has happened (and she will have been sent papers about it by the Court), then the creditor is entitled to enforce the judgement by means of a Charging Order. Again, this operates as though it is a mortgage. She would have been notified by the court as each stage is reached.
Otherwise, the agency may, if she has a leasehold, have bought the freehold and now be requiring her to pay the ground rent that is due under the lease.
In any event, she needs to check things out carefully. To do this, she could always ring the Land Registry, who are usually very helpful about explaining exactly what their letters mean: they are aware that not everyone is familiar with the law.
How can I stop a Debt recovery action with a repayment plan in place?
I am dealing with a Bank & the FOS behalf of my daughter. We are challenging them on a mis-selling of a bank loan. The only benificery was the bank because all the money went to them to pay off 'penalty charges'
We have an offer for the penalty charges to be paid back; however they will take out the balance of the loan from the any money they repay.
At the same time of this offer a letter arrived 'demanding' the loan repayment. I contacted the Bank and after a lot of duress I agreed to a payment of £10.00 per month as I was told it would be the only way to prevent a Debt Recovery service making contact.
However within days of this agreement that is exactly what happened. I called they said it was an error, 10 days later another letter, another 'error' with a letter saying "I have advised our agents not to contact you again"
We had another letter at the weekend giving us 10 days to pay. The bank have said they will investigate, I want to stop them, anyone know how we can stop them?
Stay on top of it. Try contacting upper management at the collection agency to work out the kinks in the declaration.
Remember this, more than three telephone calls per day from someone demanding money is considered demanding money with menace.
how long is it before the debt is lost?
in 2001 my car was reposesed i took it to leeds car auction under the instructeds of a.f.s , the car was sold but there was a short fall of about £800 , since then i had nowhere to live ( i was homeless after me and my wife split ) until 3 years ago now i have struggled to get my house and keep it .this debt recovery agent has found me and telling me that i owe £1,132.22 , i was led to belive that after so long( about 5 years) the debt was rote off and my name was black listed , can you tell me how long is it before the debt is wrote off if they dont contact you,( its 7 years this year since the car was taken back) . thank you malcolm.
Debt is never lost, they just disappear for a while but never gone unless you file bankruptcy, and this should be a last resort.

Loops holes have deliberately created. This is the modus operandi. The business he has started depending on the loan has flopped. He could not purchase raw materials and machineries.His children are threatning suicide if their only dwelling house is taken over and they are forced on the street. Can anybody please advise ?

Proving my ability to adapt, with no collections experience I have exceeded my gate goal of $1,500 for the month of April and expected to finish over 300% of the goal.

I think it's fine, and I assume you are applying for a particular internship or job that they already know about? But one thing I see missing is what are you asking them for? A job? An interview? Consideration? Maybe in the first sentence you could tell them what you want out of their time in reading the letter, or something.
If I'm going through a stack of 90 resumes and cover letters, it's really helpful to me to know that the person can communicate clearly and is respectful of my time. I like employees that think that way, and I like putting people who think that way in front of customers.
What can i do about unpaid bank charges?
About 4 years ago just after i had turned 18 my account went overdrawn by £5 without realising, the 1st time that i realised about this was when i recieved a statment and i was now £33 overdrawn due to a £28 charge that they had given me, after speaking to them they told me that i would have to pay this even after telling them that i didnt have the money to pay them. This resulted in them putting £28 charges on every month and thus spiraling into an amount that i couldnt pay, i then recieved a phone call saying pay £x now or we'll be passing this on to debt recovery i told them that i wouldnt be able to pay. Anyway the debt was passed on and i've had a few letters from debt recovery agents requesting payments which i couldnt make but nothing has come of these. I believe the debt stands at something like £350 which is a bit much from £5.
How do i get myself out of this mess, I'm currently at university so im not really in a position to pay £350 outright.

Tou may pay your debt later when you make money, and you can repair your credit record, and your debt amount will not increase with this thing.
Catalogue debt gone to the wrong address?
my father in-law knocked at my door asking me if i had a catalogue and i said no (as of now i dont and have not for at keast 2 years) he said you must as ive had a letter to my (his address) but stated it had my partners name on, he had no letter with him and walked off i told him if there had been a mix up give me the letter and id deal with it but he kept on walking. He bothered his son at work then my partner went round to see him didnt show him the letter just said there was a phone number to ring. His dad then told my brother in law his girlfriend rang the company ( which is not the catalogue and now a recovery agent) and they told her that i transfered it from my name name ( not even the same surname as his) and my address to his adress.I dont even think a recovery agent would have that information, only the amount and address given. He has only lived at his new address for 6 months and if this bill is ours no one has called here to collect any money, anyway he never bothers with us since his divorce so i wouldnt know his address anyway. The only thing i can think is a genuine mistake as my partners middle name is the same as his dads first name but spelt slightly different. He has took this to the police( yes his own family) and had the police onto us trying to get us for fraud, not even trying to sort it through or showing us the letter, just a bunch of lies and then the police to follow.
Can anyone tell me if you called a recovery agent would they know anything about where items were delivered or would they just have the name and amount owed. If this is a mistake by the agent and they began looking elsewhere for this person before eliminating this address why did he take it this far its his dad. i need some help i cant sleep knowing the police are involved, am 23 2 small children i dont cause anyone bother, but i just cant rest till this is over.

By opening a letter not addressed to him, your fil has committed an offence. The debt collection agency will continue to write to his address, espcially as someone at that address has admitted liability by ringing the helpline number. I would therefore let them deal with it and be hassled by this company. If your fil sees sense and returns correspondence unopened, then you may need to deal with them, assuming they track you down.
The Police will not be interested - I cant see how this is fraud and anyway the catalogue company would be the ones to prosecute, not yr fil.

There seems to be three aspects.
(i) Frustration in children due to circumstances>>
Your family is passing through difficult times. You people require patience and trust in God. Every member of the family should boost each other's morals. Just because of heavy monetary loss it is not life's end. It is a matter of time. "This too will pass". Incoming years - by grace of god the family may earn more and gain more prosperity. You being elder person, please reconcile the situation and make all family members understand that it was effect of wrong time and blame for wrong decisions if any must not be discussed at all. The necessity of time is to increase positive thinking. All members of family should unite to face the problem.
(ii) Legal remedies>>>
I donot comment. You yourself are a lawyer. You know the procedures are quite time-consuming, expensive and mental-tension- increasing. Better to avoid. But you are better judge.
(iii) Practical suggestion>>
Much mental tension seems to be house.The bank has given Rs.2 lac only against its value of Rs.10 lac. Due to underfinancing child's project has flopped. At this juncture, you can have dialogue with some good bank or financial institution. Get the house refinanced. If you get loan which interalia is sufficient to repay the loan ofCo-operative Bank - you will get rid of relationship of Co-op. Bank and the property will not be disposed off immediately at throw-away price. Your family get more time to repay the loan.
