debt collector issue?
I am a guy that pays all of his bills on time all my life. I take pride in that, but today i just got a letter from a debt collection agency named Nationwide Collection Inc. This company is asking for $29.44 from a debt to Columbia House. 1st it was over 6 years ago when i was a member with that organization and if my memory served me right i closed the account with a zero balance. What really gets me on how this company wrote this letter. they wrote in large bold letters UNLESS WE RECEIVE PAYMENT, WE ARE READY TO CONSIDER THE ISSUE OF LEGAL PROCEEDING IN THE COUNTY COURT. then they went on telling me a court judgment would make it difficult to get credit. They mentioned legal action 8 times, and they told me that this default has not YET been reported to the three credit agencies. they have a section to leave your credit card # ETC. and mail it into them to prevent legal action. Something is not right with this, one it seems like a scam if it not they had to violate some form of law? All the bark over 30 bucks, looks like there after a credit card number. What my question is are these guy legit Nationwide Collections? or should call the police or a state agency. I live in Minnesota if that helps thanks. I also checked with the department of Commerce and they are not licensed with MN.
2. Did they give you a fair debt memorandum? (Ex: the Attorney for the plaintiff is a debt collector, etc.
3. Do you still have your statement that states amount was zero
4. Go on the internet - State of Minnesota and look under business entity or call the State of Minnesota to see if there is a resident agent for Nationwide Collection Inc.- if there not a resident agent they cannot practice their business in the State of Minnesota.
5. If you answer no on 1 and 2 then they are in violation of fair debt collection act.
6. I would contact the State - Attorney General to file complaint.
I know Nationwide Collections, they've been around a while.
First let me just say - you have to take this with a grain of salt. You got to remember that those letters are computer generated templates, the only variables are the balance and your address. They send out thousands and thousands of these letters. So yes it looks crazy over $30 but thats because the computer doesn't see that it just prints the letter and fills in your little amount. Some are $30 some are $30,000.00
This being said, yes they do offer credit card payments on debts, it's not a scam though I can appreciate your caution about it.
My suggestion would be that you send them a rebuttal in writing, asking them to prove the debit because you dispute the validity. That will keep them busy for about 30 to 60 days while they go back to Columbia house and try to prove that you really owe the money.
It also means your credit report will show this as being in dispute, which in the even this being reported, you want to have stated on your file to keep your prestine credit.

Statute of limitiations no more than 7 years in all states.
Tell them to kiss your _____.
Do not give them any information.
And do not agree to pay anything, this would resent the statute of limitations.
Also, I don't think any company would send you to collection for less than 200 dollars.
Keep that letter in a file in case they keep harrassing you. But do not respond, what they are doing is stupid.
Technically, a debt collector can come after you forever...however, once the statute of limitations is up...they've lost the power to take legal action. Per the Fair Debt Collection Practices Act you can send them a "cease communications" letter and that will be all that you need to do. Per this law they must cease collection activity.
Send the collection agency a letter via Certified Mail + Return Receipt stating:
Per the Fair Debt Collection Practices Act, I am requesting that you cease all communications with me about this alleged debt.
If I were you, I would send them off a letter informing them that they violated the FDCPA regulations in the following way:
TITLE 15--COMMERCE AND TRADE
CHAPTER 41--CONSUMER CREDIT PROTECTION
SUBCHAPTER V--DEBT COLLECTION PRACTICES
Sec. 1692e. False or misleading representations
A debt collector may not use any false, deceptive, or misleading
representation or means in connection with the collection of any debt.
Without limiting the general application of the foregoing, the following
conduct is a violation of this section:
3) The false representation or implication that any individual
is an attorney or that any communication is from an attorney.
(4) The representation or implication that nonpayment of any
debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages
of any person unless such action is lawful and the debt collector or
creditor intends to take such action.
(5) The threat to take any action that cannot legally be taken
or that is not intended to be taken.
(6) The false representation or implication that a sale,
referral, or other transfer of any interest in a debt shall cause
the consumer to--
(A) lose any claim or defense to payment of the debt; or
(B) become subject to any practice prohibited by this
subchapter.
10) The use of any false representation or deceptive means to
collect or attempt to collect any debt or to obtain information
concerning a consumer.
Also inform them that under 15USC1692k, you can sue them for up to $1000 in damages and court costs.

This company is well know for FDCA violations. A good attorney can get you a few thousand for this.
If you don't want to mess with it, simply send them a certified letter informing them that this debt is beyond the statute of limitations, and that they are to "cease and desist" all further communications with you.
Also check your credit reports to make sure they haven't placed this on it...if so send a dispute to the credit bureaus.
If they don't go away after 30 days, you really need to sue them.
Should I pay NCO FIN/09 Collection Agency?
I live in C.A. and my credit report shows I owe $501 to NCO FIN/09. They bought the debt from an agency called Nationwide Credit on 4-1-07 and the original creditor was Directv. Now I see several different dates in regards to the debt as I will try to show...
Nationwide Credit date reported 02/06, date assigned 11/05, date of 1st delinquency 03/05, balance date 02/06, and status date 02/06
NCO FIN/09 date opened 04/07 and account status CLOSED
My question is should I contact NCO because I have yet to receive any letter or phone calls from them or from the previous collectors. Will NCO use the date of 04/01/07 under my negative listing on my credit report or are they required to use the ABSOLUTE ORGINAL DATE OF 1ST DELINQUENCY which was March of 2005?
Here is the bottom line....
You have a collection account on your credit report, and paying it will NOT help your score. The only way for you to do that is to get the tradeline removed.
First, you need to send a demand to validate letter to NCO, and once they receive it, file a written dispute with the credit bureaus. Send these letters certified mail, return receipt. Keep the green cards and copies of all letters.
NCO is a major bottom feeder collection agency, and from my reading they usually fold with a DV letter, especially on these old DirectTV accounts.
IF they can properly validate the account, then you can negotiate a pay for delete agreement with them, so the negative listing is removed.
I suggest you visit Creditboards.com and Creditinfocenter.com and do some reading about NCO on their forums.

Collection agencies are shady with their re-dating and illegal practices. The date of default is the date of 1st default with the original creditor. If it goes to collections it's the date the agency first reported it to the credit bureau.
