Former Ohio AG to Head Up New Financial Regulator InsideARM

Speculated that Warren’s reputation among Republicans in the Senate meant that she would not have successfully been confirmed to lead the new financial regulatory agency.

Warren will return to Harvard in the short term to teach and will continue her work as a consumer advocate. Many pundits are predicting that she will run for U.S. Senate in Massachusetts to challenge Sen. Scott Brown (R) to win back the late Ted Kennedy’s seat.

The CFPB was created last year to oversee financial products marketed to consumers. It will roll up regulatory responsibilities from various existing agencies.

For the debt collection and broader accounts receivable management industry, enforcement previously handled by the Federal Trade Commission will now be in the domain of the CFPB. Not only will the CFPB have the authority to enforce debt collection laws like the Fair Debt Collection Practices Act (FDCPA), it will also have the ability to write enforceable rules.

Can a debt collector physically show up to your home to collect on a home equity mortgage?

I was a collector of unsecured debt for years ( I was the guy that hounds you on the phone :(). I know the FTC regulates debt collection through the Federal Debt Collectors Practices Act. I remember my boss telling me about the Good Ol' Days when he would go to peoples homes and actually reclaim furniture, pianos etc. I am looking for specifics. Thanks in advance!

In your case, I approve of it.

No. These guys bluff better than poker players or hustlers in a pool hall. You don't owe anything to the debt collector. You owe the retailer or merchant. The retailer/merchant sold your debt to the collector for pennies and now the debt collector is trying to collect from you so they can make a profit for the buy off the retailer you are dissing.

Collection Agency harassing....?

I had received calls from these "Lawyers" 3 times a day telling me if I didnt pay my bill they were going to garnish my wages, I actuall yelled at them one time to stop calling me.. I dont know what to do.. how do I go about paying my bill? Is it going to be turned over to another attorney? someone, some advice please?.. This is some of what I found....

A statewide class action has been filed in New York against collection specialists, Cohen & Slamowitz. The action is brought on behalf of all New York residents who received form type collection letters from the firm and/or who have been alleged victims of the firm’s alleged harassing collection tactics. The action is brought under the federal Fair Debt Collection Practices Act and seeks actual and statutory damages as well as injunctive and declaratory relief.

They are allowed to contact you to tell you they are going to take legal action. But if it's to convince you to pay and not in the nature of notice of the garnish, then it is harassment and that is what your post describes. You need to contact the attorney that is suing them under the action is brought on behalf of all New York residents who received form type collection letters from the firm and/or who have been alleged victims of the firm’s alleged harassing collection tactics.

Your debt should be paid by Cohen & Slamowitz. That is to say that at least the settlement or convictions will clear your debt because they nullified the ability to collect. The creditor will have to sue Cohen & Slamowitz. for that debt in were as a person sues their lawyer for malpractice when they lose their money. Once malpractice is the issue, the lawyer pays cost, which would be your debt. The case cannot be started over again against you. You will be out of the picture for ever once it is passed to Cohen & Slamowitz.

You have to get your name and account on the witness list. These lawyers usually don't charge you any fees to join the class action.

Fair Debt Collection Practices Act is exactly what your situation falls under. Get the name and address of the "lawyers" who are harassing you. Send them a certified letter that tells them to buzz off and leave you alone. If they continue after that point, file a report with your secretary of state.

Honey, if you havent figured out how to "go about paying my bill" then you have bigger issues!

"harrassing collection tactics" - guess what if you paid your bills they wouldnt even have the business of calling you in the first place. Running up credit, then not paying it is the same damn thing as theft

FDCP Act is what this would fall under. There are certain limitations that a collector must abide to. For example, the number of times they can call (once they speak to you- this doesn't count if they are leaving messages, or getting no answer), the time of day they can call, etc. You can send them a letter stating you do not want them to call you any more, and you will settle any debt owned, and they are then legally obligated to stop calling you.
